MBABANE:Maphevu Mkhatjwa will not be confirmed as the Commissioner of the Anti Corruption Commission(ACC), Justice and Constitutional Affairs Minister Prince Simelane has confirmed through an affidavit filed in court.
The affidavit has been filed in response to allegations made by suspended ACC Investigator Bongnkhosi Dlamini who is challenging the appointment of Mkhatjwa as Acting ACC Commissioner.
“I admit that the first respondent does not meet the requirements of being appointed as a substantive Commissioner,” said the Justice Minister.
But the Justice Minister clarified that even though Mkhatjwa “does not qualify to be appointed as ACC Commissioner as the law suggests that he must first qualify to be appointment as a Judge”, he does qualify to be appointed as the Acting Commissioner.
“The empowering legislation imposes no time limit on the duration of an acting appointment,” said the Justice Minister.
