MBABANE:SwaziPharm Director Kareem Ashraff is now suing Clement Sifiso Khumalo, the seconded investigator of the Anti Corruption Commission(ACC) who investigated and subsequently applied for a warrant of arrest against him.
Worth-noting, Ashraff is suing the ACC investigator in his personal capacity and, in complete disregard of the vicarious liability principle in what appears to be a systematic intimidation against the ACC and by extension, the Office of the Director of Public Prosecutions(DPP).
The businessman of Indonesian origin is demanding R5million from the personal pocket of the ACC investigator, Ashraff stands accused of stealing billions of public funds, resulting in the shortage of drugs in public hospitals.
“As a result of the defamation and the injurious nature of the publication, the dignity and reputation Plaintiff has been damaged in the amount of E5000 000-00(five million emalangeni). This summons constitutes a demand, and by which the Defendant is to pay the aforesaid amount,” reads the court papers in part, filed by the businessman.
But the ACC is facing judicial sabotage merely for fighting corruption as Chief Justice Bheki Maphalala literally abuse his powers to protect alleged corrupt individuals including the Indonesian businessman who allegedly collapsed the health system.
Chief Justice Maphalala recently dismissed a warrant of arrest application and stopped the ACC from arresting the businessman, the ACC wants to throw the powerful and politically connected businessman behind bars for allegedly stealing about R1billion public funds through his alternative company AvaPharm(Pty) Ltd, an appeal is pending before the Supreme Court.
