REVEALED: Prosecutor Macebo Nxumalo promised a high judicial position as a Judge for persecuting pro-democracy MPs.

MBABANE: Macebo Nxumalo, the prosecutor allegedly at the centre of fabricating criminal charges against pro-democracy activists including incarcerated Members of Parliament(MPs) has been promised a high profile position as a Judge as a token of appreciation.

This was disclosed by high profile insiders within the office of the Director of Public Prosecution(DPP),the sources further provided evidence where the DPP’s office was warned against prosecuting the pro-democracy MPs Bacede Mabuza and Mthandeni Dube, however, Nxumalo proceeded with persecution.

Reached for comments,Macebo Nxumalo, the Principal Crown Counsel denied the allegations leveled against him.

“Not true Nkhosi.Angikwati loko Hlubi.Ingabe uyitfolephi wena lendzaba Hlubi? I think it's someone who wants to tarnish my name Nkhosi,”said the Principal Crown Counsel.

But evidence in our possession suggests that the DPP’s office was allegedly advised of by Advocate Garett Leppan that there was no evidence against the MPs, Garett was hired by the State to handle the matter and further provide appropriate advice.

“A perusal of this memorandum may reveal an inordinate attention to detail but as the matter presently stands, we do not have any evidence that implicates the suspects, one or more, in any specific offence. Various offences relating to the actions and or words of the suspects come to mind, including sedition, treason, public violence, offences under the Suppression of Terrorism Act, incitement to commit said offences, refusal to obey police officers’ lawful command, and even, as discussed murder. However, as it stands, no one offence has its elements fully satisfied,” reads the report seen by this Swaziland News.

Insiders within the DPP’s office told this publication that Macebo Nxumalo has been ignoring even internal correspondence, working with other officials with the Attorney General’s(AG) office to manipulate the law and implement royal orders.

“He has been promised a position as a Judge and therefore takes orders from those in power without following the law,”said an insider.

Worth-noting, two previous Directors of Public Prosecutions(DPP) Mummcy Dlamini and Nkosinathi Maseko were appointed Judges as a token of appreciation for their loyalty.

Judge Dlamini is now handling the politically motivated terrorism case involving pro-democracy MPs Bacede Mabuza and Mthandeni Dube while Judge Maseko was appointed after persecuting Nation Magazine editor Bheki Makhubu and human rights lawyer Thulani Maseko for writing articles critical about the regime.

Reached for comments earlier, DPP Phila Dlamini declined to comment on the matter.

“No comment,” said the DPP.

According to the Constitution, the office of the DPP shall work independently, however, in eSwatini, it is used to persecute pro-democracy activists including MPs who are critical of King Mswati’s regime.
