“In the affidavit of the said Honourable Minister,Phila Buthelezi, the Court will note that the 2nd Respondent so cited is a respondent to which I am the General Secretary of. It is my humble submission that an order was granted against the 2nd Respondent incorrectly and without his knowledge and presence. The same is applicable to myself as mentioned above. In law I am advised that on that basis alone, the application must be granted, the Applicants were not in court and had not been notified that the matter was proceeding. Argument will be addressed to the court at the hearing of the matter to the effect that the service was irregular,” reads Nkambule’s affidavit in part.
