Judge Qinisile Mabuza made a fair judgement back in 2008 in a case between former competing Members of Parliament(MPs) Mabhanisi Dlamini and the late Sibusiso Nkambule, when she ordered that, the disputed elections at Kwaluseni Constituency should be started afresh.
This was after some voters were denied entry at Kwaluseni Primary School hence their right to vote was violated.
Due to the struggle of life, I found myself residing at Kwaluseni at the time owning a Spaza phone business hence I was privy with regards to the events that unfolded during the voting process.
It’s true that, some of Mabhanisi’s supporters were denied the right to vote, the Elections Commission officers closed the voting process while people were queuing in a huge line, waiting to vote.
As a result, Mabhanisi lost the elections to the late former MP and considering the difference with regards to the number of votes, Mabhanisi had a strong believe that if his supporters were allowed to vote, he was going to win the elections.
As a result, he successfully ran to court and the court ruled that, Kwaluseni Constituency elections should be started afresh.
Worth-.noting, it was the people who strengthened Mabhanisi’s case by filing affidavits with the court, demanding their right to vote.
I am suggesting that it was a fair judgement by the Honorable Judge because I was at Kwaluseni, some of Mabhanisi’s supporters were denied the right to vote.
Subsequent to the court judgement, elections were started afresh and Mabhanisi won the elections beating the late Sibusiso Nkambule.
But now, Mabhanisi seems to planning to take the legal route again, he claims there was vote rigging during the Special Voting, perhaps, he has remembered that he once won elections after taking the Elections Commission to court.
Unfortunately, it seems he doesn’t have a case time but, that does not mean he cannot try his luck who knows, maybe he can win.
It’s very difficult for Mabhanisi to win elections at Kwaluseni this time, even if the elections could be started afresh.
