Eswatini court grants request to have ‘AKA’ suspects extradited, to be handed over to South African law enforcement agencies.

MANZINI:Natasha Ramkisson-Kara, the National Prosecution Authority(NPA) KwaZulu Natal Regional Spokesperson has confirmed that, eSwatini court has granted the request to have Siyabonga Gezani Ndimande and Dave Ndimande extradited to South Africa.

The suspects are wanted in South Africa for allegedly killing ‘AKA’, the court granted the request on Friday and the suspects are left with an option to either appeal or be handed over to South African law enforcement agencies.

“The NPA can confirm that the Manzini Magistrates’ Court in Eswatini has granted South Africa’s request for the extradition of two suspects in the AKA and TIBZ murder case. The suspects (Respondents), Siyabonga Gezani Ndimande and Malusi Dave Ndimande will now have 15 court days to appeal the decision.Should they not appeal within the 15-court day period, then the record of the proceedings will be transmitted to the Prime Minister of Eswatini to decide on the surrender of the Respondents to South Africa. Following the Prime Minister’s decision to surrender, Interpol Eswatini and Interpol SA will decide on a date of handover. If there is an appeal lodged by the Respondents, then a Notice of Appeal should be filed by the Respondents within the 15-court day period. The record of proceedings should be filed with the High Court thereafter. Dates are then arranged with the presiding Judge on the filing of Heads of Argument by both parties. Whereupon the matter is set down for the appeal to be heard.If the appeal is dismissed then the process regarding the Prime Minister will follow the course as stated above.In February 2023, AKA (Kiernan Forbes) and TIBZ (Tebello Motsoane), were shot and killed outside a restaurant in Florida Road, just outside the Durban CBD”, said the NPA KwaZulu Natal Regional Spokesperson in a statement released on Friday.
