Galp Matsapha owner Issufo Calu files complaint with the Office of Chief Justice, wants Judge Titus Mlangeni removed for alleged misconduct.

MBABANE:Issufomia Calu,the Director of Ncamase Investments-Galp Matsapha has filed a formal complaint with the Office of the Chief Justice, he wants Judge Titus Mlangeni removed for alleged misconduct in that, he allegedly favored Galp Eswatini in the matter with Ncamase Investments.

But in the complaint copied to the Justice Minister and Office Attorney General(AG) Sifiso Khumalo,the businessman further accused the Judge of conducting ‘secret contempt of court proceedings’ with an alleged intention to jail him.

The Judge went on to jail Calu’s lawyer Mangaliso Magagula, the President of the Law Society of Eswatini(LSE) who represented Ncamase Investments for referring or labelling court proceedings a ‘secret meeting’.

“Justice Mlangeni’s conduct aforesaid, amounts to interference with the administration of justice and therefore conduct that violates his oath of office and the judicial code of ethics. It is also criminal conduct in which the Judge engage in conduct that defeats the ends of justice. This conduct is also corrupt and violates the Corruption Act and the Leadership Code. Justice Mlangeni committed misconduct by conducting contempt proceedings in the absence of Ncamase, the party accused of being in contempt. The hearing was attended only by Galp’s legal representative and Justice Mlangeni after Namase’s legal representatives were served with a notice of set down to appear before the Judge at 11:30 whilst the hearing took place at 9:30. On 25 July 2024, Justice Mlangeni heard contempt proceedings against Namase in its absence. The hearing took place earlier than the matter was set down for by Galp’s representatives. Justice Mlangeni conducted the hearing with Galp’s legal representative in the absence of Ncamase’s legal representative at 9:30 am, when it had actually been allocated 11:30 am for the hearing. On 10 July 2024, Galp’s legal representative served Ncamase’s legal representative with a Notice of Setdown for 1 July 2024 for the hearing of the contempt application. Galp’s legal representative, together with Ncamase’s legal representative, appeared before Justice Mlangeni on 1 July 2024. Justice Mlangeni postponed the hearing of the contempt proceedings to 25 July 2024. Galp’s representatives served Ncamase’s representatives with a Notice of Set Down reflecting that the matter would be heard on 25 July 2025, at 11:30 am,”reads the complaint in part, filed on Thursday this week.
