MBABANE: Incarcerated pro-democracy Members of Parliament(MPs) Bacede Mabuza and Mthandeni Dube have filed a fresh bail application.
The MPs were arrested by Mswati’s police for demanding democratic reforms, they are facing politically motivated terrorism charges.
Soon after MP Mthandeni Dube concluded his testimony on Wednesday, the court proceeded to hear their bail hearing.
Court documents in our possession suggest that the bail application has been filed with a ‘certificate’ of urgency.
“This is an urgent bail application in terms of Section 95 (1) and (2) read with Section 96 (1) (a) of the Criminal Procedure and Evidence Act, No 67 of 1938.The Applicants’ liberty is enshrined in the Constitution by virtue of the provisions of Section 14 (1) (a) and 16 (17) of the Constitution, Act 001 of 2005,” read the documents.
