Shortly after Industrial Court Judge Lungile Msimango delivered a judgement in favour of SNAT President Mbongwa Dlamini,I conducted some quick online research to analyse some of her previous judgements.
One of the fair judgements delivered by Judge Msimango is that of Lidwala Manager Sikhumbuzo Nkambule, who was unfairly dismissed by the insurance company, the Honorable Judge ruled in favour of Nkambule.
Like rain in the desert, justice is fast becoming scarce within the judiciary hence, we need to applaud and appreciate every single drop of rain that falls in this ‘desert’.
Judge Msimango is surely becoming a duplication of Judge Qinisile Mabuza,who is respected within the African continent for her fair judgements.
It was Judge Qinisile Mabuza whose judgement resulted in the late Mzikayise Ntjangase being buried at Mkhwakhweni, much against the wishes of a certain clique within the royal family who were against the decision amid disputes among Chiefs.
It was Judge Mabuza’s judgements that restored the integrity of the judiciary over ten(10)years ago, but Chief Justice Michael Ramodibedi and his successor, Judge Bheki Maphalala, turned the judiciary into kangaroo courts.
Now, we have a captured Judge within the Industrial Court in Judge Abande Dlamini who always rules in favor of government even on clear cases of injustice against workers.
But again it seems a female Judge is determined to restore the integrity of the Industrial Court.
We are aware that the State might appeal the judgement and intimidate Judges of the Industrial Court of Appeal, but at least Judge Lungile Msimango has played her part by delivering a fair judgement.
Attorney General (AG) Sifiso Mashampu Khumalo might play the game of power by appealing the judgement and intimidate Judges to rule in favour of the government, we are aware of that, and we won’t be surprised.
The State must respect the decision of it’s captured judiciary and pay the President of the Swaziland National Association of Teachers (SNAT) his monies.
As per the court’s judgement,it was wrong in the first place to stop his salary.
