NKHANINI: Timothy Myeni, the aspiring vocal Member of Parliament(MP) has been ‘disqualified’ from standing for elections at Lubulini amid lawful registration objections, Mbonisi Bhembe, the Spokesperson of the Elections and Boundaries Commission(EBC) has clarified.
This comes after this Swaziland News reported that the EBC ‘disqualified’ Myeni from contesting at Lubulini and directed that he must stand for elections at Nkilongo Inkhundla.
Myeni later told this publication that intends approaching courts regarding the decision.
“As we speak,my lawyers are drafting court papers, we are challenging the decision,” said the former MP on Friday afternoon.
But Mbonisi Bhembe, the EBC Spokesperson, when responding to a questionnaire from this Swaziland News on Friday said, he will not respond specifically, on Myeni’s issue but, will explain the legal due process undertaken by the Commission in matters where, the registration of any LiSwati “is being” legally objected.
It has been disclosed that Myeni was disqualified, after a complaint filed with the EBC suggesting that, he was by law, not eligible to stand for elections at Lubulini.
“What,we are fully aware of is the existence of a normal plethora of lawful registration objections, that the Commission has and continues to deal with under the law by objective determination, as I stated earlier that follows an objective criterion, which cannot and has not resulted in any eligible LiSwati being determined and disenfranchised. All there is are case of default registration classification to legal domicile, that is evidence by primarily thought not exclusively by the respective chief code of every natural LiSwati national. It is also equally important to underscore that, the objection determination process by the Commission is as a discretion granted to the Commission which is applied semi-judiciously, in line with settled principles of Administrative law, where Statutory law conferred discretion is exercised,” said the EBC Spokesperson.
