MBABANE: Big-Bend Acting Magistrate Lucas Dlamini has been taken to the High Court for allegedly presiding over cases without a contract.
This comes a few days after this Swaziland News reported that, some Acting Magistrates, Judges and Master of the High Court Assistants are without contracts amid delay in the appointment of the Judicial Service Commission(JSC).
The Acting Magistrate was stopped from delivering a judgement this week and this, was after lawyer Professor Msibi from Magagula Attorneys filed an urgent application, declaring his continued presiding of cases unlawful on the basis that, he “does not have a contract of employment and/ or a legal instrument” empowering him to work as a Magistrate.
The matter is before Judge John Magagula and, the delay in the appointment of the JSC has triggered a judicial crisis.
