MBABANE:Attorney General(AG) Sifiso Khumalo, is the brain behind the Computer Crime and Cyber Crime Act that has resulted to emaSwati facing arrests merely for, viewing their love partners Whatsap messages.
Worth-noting, Khumalo whose Office is responsible for preparing or facilitating Bills to be debated and passed by Parliament, was allegedly confronted several times by married men for allegedly sleeping with their wives.
The men confronted Khumalo after discovering WhatsApp messages alleging that he was having ‘unlawful’ sex with them.
One of the men is Shuko Willie Chunga, a Zambian national who allegedly discovered Whatsap messages in his wife’s cellphone, the Zambian subsequently sued the eSwatini Attorney General for allegedly having sex with his wife Nukwasa Hilda Mwanza Chunga.
It has alleged that, after being confronted by different men for sleeping with their wives, the AG subsequently abused State power and influenced the inclusion of a provision in the Cyber Act, banning all emaSwati from viewing their love partner’s cellphones.
With the new law, the Attorney General will not only cheat or have sex with married women in ‘peace’ or with impunity but, he will now have more powers to influence the arrest of any man who will confront him for allegedly sleeping with his wife by advising the wife to open a criminal case.
The Attorney General declined to comment about the matter.
On another note, the Attorney General tried to include provisions, seeking to restrict the independence of online media merely for exposing him, he wanted emaSwati to pay a fine amounting to R10million merely for sharing information on Whatsap.
But this week, Dumsile Dludlu was arrested by the police merely for viewing her husband’s WhatsApp messages, she appeared at the Mbabane Magistrates Court and was remanded out of custody pending trial.
The arrest resulted to members of the public criticizing the law on social media saying, it might promote adultery,escalate Gender Based Violence(GBV) cases and further limit trust among married couples.
