Chief Justice orders Judge Bongani Dlamini to rescind court order allegedly forged by his alleged ‘girlfriend’ Assistant High Court Registrar Sphephile Hlatjwako, no disciplinary action.

MBABANE:Chief Justice Bheki Maphalala has once again abused his powers in that, he allegedly ordered Judge Bongani Stanley Dlamini to rescind or cancel Judge Qinisile Mabuza’s court order that was allegedly forged by Assistant High Court Registrar Sphephile Hlatjwako without taking action against the suspect.

The Assistant High Court Registrar was known to be in an alleged relationship with the Honorable Chief Justice, according to information obtained by this Swaziland News and confirmed by senior judicial officers.

It has been disclosed that,Hlatjwako first went to Supreme Court Registrar Banele Ngcamphalala to confess that, she forged the widely reported court order.

Ngcamphalala subsequently accompanied her to the Office of the Chief Justice where it was agreed that, the matter must be kept a top secret, the CJ then allegedly ordered Judge Bongani Stantly Dlamini to cancel the forged order.

This means Mahlangatja Indvuna YeNkhundla Mduduzi Fakudze who was fraudulently divorced, is now legally married to Nothando Temerica Dlamini-Fakudze as the Marriage Certificate has been reinstated in the Home Affairs Computer Government System.

The Assistant Registrar allegedly forged the court to assist her relative however,the Indvuna YeNkhundla approached the court and it was discovered that, he was unlawfully divorced.

Reached for comments by this publication,lawyer Sibusiso Nhlabatsi said, a forged court order can be rescinded by a Judge in terms of High Court rules.

“Yes an order granted through fraud is liable for rescission in terms of Rule 31 and Rule 42 of the High Court Rules.It can also be rescinded under common law”, he said.

Both the Chief Justice and the Assistant High Court Registrar declined to comment about the matter.

But a senior judicial officer who spoke to this publication said, should the Chief Justice fail to take action against the Assistant High Court Registrar, that would mean other officers will do the same with impunity.

“It would be hard for the CJ to discipline us if he fails to handle this matter and discipline Sphephile, particularly because it was known here that, there were dating,” said the senior judicial officer.

The matter of the forged court order was widely reported by this Swaziland News last week and it was alleged that, the Assitant High Court Registrar who allegedly forged the order of the court approached the Chief Justice and confessed that, she committed the crime while asking for forgiveness.

The CJ is alleged to have then instructed Judge Bongani Dlamini to cancel the forged court order and reinstate the marriage between Mduduzi Fakudze and Nothando Temerica Dlamini-Fakudze.
